Issuance of a manpower supply agency license

  • The application is subject to the provisions, laws, regulations, bylaws and decisions issued by the concerned executive authorities in the Kingdom of Bahrain.
  • The applicant must be Bahraini citizen or a business owner of a (commercial register ) fully owned by a Bahraini citizen .
  • Payment of all fees due to LMRA.
  • The license applicant, licensee or business owner should not breach any of the essential obligations imposed by the laws of regulating the labour market , regulations, bylaws and decisions issued to implement them .
  • That the license applicant has not previously been issued an employment office license which has been revoked in accordance with the provisions of the law
  • Payment of fines imposed on him according to final verdicts in accordance with the provisions of the law regulating the labour market .
  • That the license applicant or licensee does not have a commercial activity that contradicts the activity required by the administrative requirements for granting the license.
  • The license applicant must not be registered as an employee in the Social Insurance Organization .
  • The license applicant must pass the interview by the concerned personnel in LMRA .
  • Managing the licensing activity by the applicant himself or appointing a Bahraini manager to manage it .
  • Specifying the economic or vocational specialization for which he wishes to supply for, provided that this specialization is among the special activities and occupations determined by LMRA , without breaching the conditions for granting work permits or temporary work permits
  • Providing accommodation for the expatriate workers employed by the manpower supply agency, adequate in terms of number and gender, in accordance with the provisions of the law in this regard.
  • Practicing the activity at the licensed premises appearing in the license . The activity is not to be practiced with other commercial activities, except for related similar activities according to the administrative requirements for granting the licence.
  • Depositing an amount of two hundred Bahraini dinars for each work permit issued as an insurance to be paid to LMRA , in addition to the set fee of the work permit.
  • Placing the license certificate in an evident place at the premises the activity is being practiced in as well as the place of temporary housing for females.
  • Notifying LMRA immediately when the data contained in the application is changed or updated, or immediately upon liquidation of its activity, declaration of bankruptcy, or cancellation of the commercial register in the Ministry of Industry & Commerce.
  • Enabling LMRA and its inspectors to enter the employment office premises or the residence designated for expatriate workers at any time.
  • Obtaining the required license to practice the occupation from the concerned authorities regarding the occupations of the workers that he has been authorized to employ if their occupationss are among the occupationss that are legally required to do so .
  • It should not be evident that the licensee has ceased practicing the activity , shut down, or changed the location of the activity in violation of the provisions of the laws and decisions in force.
  • The license shall expire upon the expiry of its original or renewed duration. The licensee must submit an application for renewal as per the same procedures and stipulated conditions, not more than 60 days before the License’s expiry and not less than 30 days before .
  • It is prohibited for any person to practice this activity without obtaining a licensing certificate to practice commercial activities issued by the LMRA.
  • The license will be revoked if the licensee obtains the license based on false or incorrect data or documents , if one of the conditions for granting the license is not met, or in the event of an incriminating conviction , defamation crime , or trust related convictions.
  • The initial approval period is 3 months to complete the requirements of the final approval, and in case the initial approval period has expired, the application is automatically considered canceled.

Licensing and Publicity for Rehabilitation Centers Service

First: If applicant is a natural person:

  • The applicant must not be less than 25 years old.
  • The applicant must be of full capacity and no final judgments have been issued against him in a felony or misdemeanor involving moral turpitude, dishonesty, or public morals unless he has been rehabilitated.
  • The applicant should have the financial means to finance the establishment and operation of the facility, according to what the Ministry decides. The application shall indicate the source of financing the facility, the amount allocated for its operation, and the ability to continue financing it.
  • To be able to manage the facility by himself or through a manager appointed by him so that he - or whoever he appoints - fulfills the conditions stipulated in Clause (3) of Article (4) of this Resolution.

Issuance of a manpower supply agency license

Required documents for initial approval

  • Filling out the application form for the issuance of a manpower supply agency license.
  • Submitting a plan or program supported by the samples of documents and contracts that will be during the practice of the activity in accordance with the required economic or vocational specialization in Arabic language and according to the attached form.

  • A court decision is required in the case of a compulsory liquidation.
  • A notarized power of attorney if the applicant is an unrelated party to the Commercial Registration holder, or an unnotarized power of attorney if the applicant is a professional office or an authorized employee registered on the same registration
  • If the liquidation is optional, a decision from the company owner / meeting minutes of partners / a decision from shareholders is required depending on the company type

  • Power of attorney or an authorization depending on the type of applicant, if the application is not submitted by one of the partners
  • Note: In this transaction, if the applicant is a manager or an authorized signatory who is not a partner, a power of attorney must be provided for them to submit the application
  • A no-objection letter to the working partners, managers and authorized signatories
  • A decision from the partner if they are a legal person
  • A draft of the company’s memorandum of association / articles of association / declaration of incorporation
  • Certificate issued by the bank with the company’s capital (if the company’s capital is in cash)
  • Documents of the capital in kind if the company’s capital is in kind
  • Note: If the partner is a Bahraini company, a decision must be provided by the company to either establish a new company or to enter as a partner in establishing a new company
  • LLC/Joint Liabililty Company: partners’ meeting minutes. Closed or public joint stock company: board resolution
  • If the partner is a foreign company, the following must be provided: a decision from the company to either establish a new company or to enter as a partner in establishing a new company, a copy of the company’s Commercial Registration, a copy of the company’s memorandum of association and any other amendments thereto. All these documents must be certified.

Note: If the company to be incorporated is a branch of a foreign company, the following must be provided:

  • A certified decision from the parent company to open a branch in the Kingdom of Bahrain
  • Certified power of attorney for the branch manager
  • The company’s financial report (signed by a certified auditor)
  • A letter of guarantee for the branch
  • A certified copy of the company’s Commercial Registration
  • A certified copy of the company’s memorandum of association and any other amendments thereto
